Plaintiffs' Law Firm Sued for TCPA Violations

A prolific plaintiffs' law firm is now facing a class action for alleged violations of the Telephone Consumer Protection Act (TCPA).

The lawsuit, filed February 24, 2022, by Gerard Jackson in the U.S. District Court for the Middle District of Pennsylvania, alleges that The Litigation Practice Group PC, a California-based plaintiffs' firm, made at least eight illegal marketing calls to Mr. Jackson. According to the complaint (which is available here), despite the fact that Jackson's number is on the Do Not Call registry, the law firm repeatedly made telemarketing calls to him, hoping to sell him on their credit relief services. In an effort to stop the calls, Jackson eventually engaged with a sales agent, who identified the law firm and sent an additional solicitation in a follow-up email.

As the complaint notes, this is at least the second time that The Litigation Practice Group has been sued for alleged TCPA violations. The complaint seeks injunctive relief and damages for a nationwide class of persons in the U.S. whose phone numbers are on the Do Not Call registry but nonetheless received marketing calls from the law firm.
